These Terms of Service (“Terms”) govern your use of the website and services provided by Look At Me, a trade name of Look at Me W Creek, LLC (“we,” “us,” or “our”). By accessing our website, booking an appointment, or receiving a service, you agree to these Terms.

1. Eligibility; Clients Under 18

We welcome clients under the age of 18. For any client under 18, a parent or legal guardian must complete and sign our intake, consent, and liability waiver forms on the minor's behalf, and, for services carrying a risk of allergic or adverse reaction, must be reachable during the appointment.

2. Services

Look At Me provides beauty and personal care services, including nail, lash, and brow services. All services are subject to availability and may be modified or discontinued at any time without prior notice.

3. Health Information and Informed Consent

Some services (including lash extensions, tinting, and certain nail treatments) carry a risk of allergic reaction, irritation, or other adverse reaction. You (or, for a client under 18, your parent or guardian) agree to disclose known allergies, sensitivities, or relevant medical conditions on the intake form prior to service. We may decline to perform, or may modify, a service based on that information or the client's response to a patch test. You acknowledge these risks and that results vary by individual.

3A. Lash Touch-Up Guarantee

If you experience an issue with your eyelash extensions, let us know within 5 days of your appointment and we will repair the affected lashes at no charge, typically within 2 days of your request. This guarantee does not cover damage caused by failure to follow aftercare instructions, an allergic or adverse reaction (see Section 3), or normal shedding.

4. Appointments and Booking

Appointments can be booked through our website and may be processed via our third-party booking platform. By booking an appointment, you agree to provide accurate and complete information. We reserve the right to refuse or cancel appointments at our discretion, including for misuse, inappropriate behavior, or policy violations.

5. Cancellations and Rescheduling

All cancellations and rescheduling are subject to our Cancellation Policy.  By booking an appointment, you agree to those terms.

6. Payments

Depending on the service, a valid payment method may be required to secure your appointment, and deposits or prepayments may apply. Payments may be processed by us or through our third-party provider.

We do not require you to provide personal identification information (such as your address, telephone number, or email address) as a condition of completing a credit card transaction, except where permitted by law (for example, for shipping, special orders, or fraud prevention).

6A. Gift Certificates

Gift certificates may be redeemed for any service at any of our Walnut Creek locations. Gift certificates do not expire and remain valid until redeemed. Gift certificates are not redeemable for cash, except that a gift certificate with a remaining balance of less than $15 is redeemable in cash upon request.  No service or dormancy fee will be charged against a gift certificate balance.

6B. Promotions and Referral Program

From time to time we offer promotional discounts for new or returning clients, and a refer-a-friend program under which you and a referred friend may each receive a credit toward services. Current offer terms are posted where the offer is advertised and may change or be discontinued at any time. Promotional credits have no cash value, are non-transferable, and may be limited to one use per client unless stated otherwise. By referring a friend, you confirm you have their permission to share their contact information with us for this purpose; see our Privacy Policy for how we use referral information.

7. Late Arrivals

If you arrive late to your appointment, we will do our best to accommodate you. However, your service may be shortened to avoid delays for other clients, and the full service price may still apply.

8. Text Message (SMS) Communications

If you provide your phone number, we may ask for your separate, affirmative consent to receive text messages from us, including appointment reminders and, where you opt in, marketing messages. Consent to receive marketing texts is not a condition of purchasing any service. Message and data rates may apply; message frequency varies. Reply HELP for help or STOP to opt out at any time.

9. Photography and Marketing Use

For certain services, we will ask you to complete a service-specific consent and liability waiver, which addresses your photo and video consent for that service, including your right to opt in or decline and to revoke consent at any time by written notice. That form governs photo/video use for the applicable service.

10. Third-Party Services

Our website may integrate or link to third-party services, including Boulevard. We are not responsible for the content, policies, or practices of third-party platforms.

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is owned by or licensed to Look At Me and may not be copied, reproduced, or used without our prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, Look At Me is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or any right that cannot be limited or waived under California law.

13. Indemnification

You agree to indemnify and hold Look At Me harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of our services, except to the extent caused by our own negligence or willful misconduct.

14. Dispute Resolution; Binding Arbitration

PLEASE READ — THIS AFFECTS YOUR LEGAL RIGHTS. Any dispute arising out of or relating to the Services, our website, or these Terms will be resolved by final and binding individual arbitration administered by JAMS under its Consumer Arbitration Rules, before one arbitrator, in San Francisco, California, under the Federal Arbitration Act (9 U.S.C. § 1 et seq.). You and Look At Me each waive any right to a jury trial and to participate in a class, collective, or representative action; claims may be brought only in an individual capacity. Either party may instead bring a qualifying claim in small claims court. Nothing in this section waives any right to seek public injunctive relief that cannot be waived under California law. This arbitration agreement is governed by California law and the Federal Arbitration Act.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute not subject to an arbitration agreement shall be brought in the state or federal courts located in San Francisco County, California.

16. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

16A. Service-Specific Consent Forms

Certain services require you to complete an additional service-specific consent and liability waiver (for example, our Eyelash Extensions Consent & Liability Waiver). Each such waiver is incorporated into and forms part of these Terms for that service. Where a service-specific waiver addresses health disclosures, assumption of risk, release, or photo/video consent, that waiver controls for that service. The dispute-resolution and arbitration terms in Section 14 of these Terms apply uniformly across all services.

17. Severability; No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision.

18. Changes to Terms

We may update these Terms at any time. Continued use of our website or services after a change constitutes acceptance of the updated Terms.
